These Terms of Use (“Terms”) are an agreement between you and Debt Sunset (“Debt Sunset”, “we”, “us”), which operates debtsunset.com and its debt tracker, reports and API (together, the “Service”). By using the Service or creating an account, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Who can use Debt Sunset
The Service is offered only to people located in the United States, meaning the 50 states, the District of Columbia and the U.S. territories that use the U.S. dollar (Puerto Rico, Guam, the U.S. Virgin Islands, American Samoa and the Northern Mariana Islands).
The Service is not offered to, directed at or intended for people in the European Union, the European Economic Area, the United Kingdom, Switzerland or any other country. Do not create an account or buy anything if you are located outside the United States and its territories. We may refuse, suspend or close accounts that we believe are used from outside those areas.
You must be at least 18 years old and able to form a binding contract.
2. A calculator, not financial advice
Debt Sunset is a calculator and planning tool. It does not provide financial, investment, credit, tax or legal advice, and using it does not create an advisory, fiduciary or professional relationship. All results are estimates based on what you enter and on simplifying assumptions. Your creditors’ figures will differ. You are solely responsible for your financial decisions and for checking information against your official statements. See our Financial Disclaimer.
3. Your account
You sign in with a one-time link sent to your email address. You are responsible for keeping your email account secure and for everything done with your account. Personal API tokens work like passwords. Keep them secret and revoke any you no longer use. Tell us promptly if you think your account has been misused.
We may decline or close accounts at our discretion. The Service is currently in beta (see section 4). Features may change, and the Service may have errors or interruptions.
4. Free trial and Lifetime purchase
- Free trial. New accounts get a free trial (currently 30 days) that starts when you first sign in. No payment details are needed, and nothing is charged automatically.
- Lifetime access is a one-time payment (the price shown on our Pricing page when you buy), processed by PayPal. It is not a subscription and does not renew.
- “Lifetime” means for as long as the Service is operational and Debt Sunset continues as a going concern, not for your lifetime or ours. It covers the features included in the Service as they exist at any given time. We may add, change or remove features.
- Early users. The Service is in beta for as long as the yellow beta banner is shown at the top of the site. You are an “early user” if you buy Lifetime access while that banner is shown. Early users keep Lifetime access for the price they paid, with nothing more to pay, even if the Lifetime price is raised later. This does not extend Lifetime beyond the meaning above.
- Refunds. If you are not satisfied, contact us within 30 days of your payment for a full refund. After that, payments are non-refundable except where required by law. A refund or chargeback ends Lifetime access.
- The Service may end. We may suspend, change or permanently shut down the Service, in whole or in part, at any time and for any reason, with or without notice (see section 12). Except as required by law, we are not obligated to refund purchases more than 30 days old.
5. Acceptable use
Do not misuse the Service. For example, do not:
- break the law, or use the Service for anyone else’s accounts without their permission;
- try to access other users’ data, probe or bypass our security, or interfere with the Service;
- scrape, overload or automate the Service except through the documented API within its rate limits;
- resell or sublicense access, or share your account or API tokens;
- enter full card or account numbers, bank login credentials or Social Security numbers. The Service does not need them.
6. The API
Lifetime members may use the Debt Tracker REST API for their own personal use, subject to rate limits and the API documentation. We may change, limit or discontinue the API. If you connect third-party tools (for example, AI assistants or automation services), you are responsible for the data you share with them. Their use of your data is governed by their own terms.
7. Your data
You own the information you enter. You give us permission to store and process it only to provide the Service to you, as described in our Privacy Policy. You are responsible for the accuracy of what you enter. Keep your own records: the Service is not a system of record.
8. Third-party services and content
The Service relies on and links to third parties (such as PayPal, Cloudflare and Amazon Web Services). Card and lender names and logos belong to their owners, and their use does not imply any affiliation or endorsement. We are not responsible for third-party services, websites or content.
9. Disclaimer of warranties
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, including any warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or that the Service will be uninterrupted, secure or error-free. We do not warrant that any calculation, projection, date or figure is accurate or complete, or that using the Service will reduce your debt, save you money or change your credit score.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DEBT SUNSET AND ITS OWNER AND OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, or for any loss of money, savings, profits, credit standing, data or goodwill, or for fees, interest, late charges or penalties charged by any creditor, arising from or related to your use of, or inability to use, the Service or any calculation or content, even if we were told they were possible.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR US $10.
Some jurisdictions do not allow certain limitations, so some of these may not apply to you. In that case our liability is limited to the smallest amount permitted by law.
11. Indemnity
You agree to defend, indemnify and hold harmless Debt Sunset and its owner and operators from claims, losses and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service, your violation of these Terms or your violation of anyone else’s rights.
12. Suspension and termination
You may stop using the Service and ask us to delete your account at any time. We may suspend or terminate your access, or terminate the Service as a whole, at any time and for any reason, with or without notice, including if you violate these Terms, if required by law, or to protect the Service or other users. Sections 2 and 7–14 survive termination.
Backups are your responsibility. You are solely responsible for keeping your own copies of your data. You can save it at any time by storing the responses of the Debt Tracker REST API (for example GET /api/debt-tracker/creditors, /plan and /windfalls) or with the CSV downloads in the tracker. We do not promise to keep backups for you, or to provide an export or advance notice, if your account or the Service ends.
13. Governing law and disputes
These Terms, and any dispute arising from or relating to them or to the Service, are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law rules.
If you have a concern, please contact us first at [email protected], and we will try in good faith to resolve it informally within 30 days. If we cannot, any legal action must be brought only in the state or federal courts located in the State of Florida, and you and we consent to the personal jurisdiction of those courts. Either of us may instead bring an individual claim in small claims court if it qualifies.
14. General
We may update these Terms. When we do, we will change the date above, and for significant changes we will provide more prominent notice. Continuing to use the Service after changes take effect means you accept them. If any part of these Terms is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, the Privacy Policy and the Financial Disclaimer are the entire agreement between you and us about the Service.
